IMPORTANT: Before accepting the Agreement, you are supposed to thoroughly read all contents of the Agreement, and fully know its terms, especially restrictive clauses or exceptions.
The Term of Service (hereinafter referred to as "the Agreement") is signed by you and FIBREVIEW. It includes (but not limited to) Privacy Policy of FIBREVIEW Platform and other contents.
Once you select "Agree and submit the Agreement" (see registration page for detailed wordings) and complete the registration procedure, or you use the service in any form, it will be deemed that you have read and agreed with the restriction of the Agreement and rules. If you do not agree to be bound by the terms of this Agreement, click the "Don’t Agree" button, and do not login, or use the Software.
FIBREVIEW has the right to modify the terms and conditions at any time and just publicity on the website. In case of change, FIBREVIEW will announce such change on its official website without further notification. The revised terms should enter into force after the public notice. Your use of FIBREVIEW Service after modifications will be considered as you have accepted the terms.
YOU AGREE THAT YOUR USE OF THE FIBREVIEW SERVICE ACKNOWLEDGES THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
I.Definitions of Terms
1.1Licensed software refers to software system developed by FIBREVIEW, downloaded from the platform, and installed and applied in specified system mobile terminals.
1.2Services refer to services provided for you by FIBREVIEW. You can use such services on the mobile terminal with the licensed software.
II.Service
2.1 FIBREVIEW offers you intelligent life equipment management services, based on which you can access to the intelligent terminal on FIBREVIEW Platform. Service contents include intelligent equipment management, scene interlinkage and analysis report, etc. Such functions may be optimized or modified according to changes of users' demands or judgment of service supplier, and service supply may be suspended due to regular and irregular maintenance.
2.2 Once you log in FIBREVIEW, FIBREVIEW will create account for you automatically, and you are solely responsible for all your activities and events in your account. You shall properly keep your account number and password. In case of any safety loophole for your account(including but not limited to divulgence of user password), you shall notify FIBREVIEW in time, and FIBREVIEW will assist you in taking relevant measures. Otherwise, all behaviors related to your account shall be assumed by you and you will bear all responsibilities.
2.3 FIBREVIEW may change, upgrade or transfer the licensed software or relevant functions from time to time, and may add new functions or services in the licensed software system. If no separate agreements are accompanied with the aforesaid new functions or services, you are entitled to the corresponding functions and services, which is also subject to the Agreement.
2.4 The user understands and accepts that this application only provides functional services related to hardware products supported by FIBREVIEW, in addition to the equipment related to this application (such as personal computers, mobile phones, and other devices related to access to the Internet or mobile Internet. devices) and the required fees (such as telephone charges and Internet access charges paid for accessing the Internet, and mobile phone charges paid for using the mobile network) shall be paid by the user.
III.Service Application Standard
3.1 You are prohibited to license, sell, lease, transfer, issue the product in any form, or use the product for other commercial purpose.
3.2 Due to limitations on software adaptation platform and terminals, you can only use the licensed software in the authorized system platform and terminal; if you install the licensed software on other terminal equipment, it may damage your hardware or software function.
3.3 You shall properly keep your account number and password. In case of any safety loophole for your account(including but not limited to divulgence of user password), you shall notify FIBREVIEW in time, and FIBREVIEW will assist you in taking relevant measures. Otherwise, all behaviors related to your account shall be assumed by you and you will bear all responsibilities.
3.4 You shall be responsible for the accuracy, reliability, integrity and legality of input data and legality of the way in which you obtain the data, and shall back up data and information from time to time. You shall bear all risks for damage and loss of such information.
3.5 Users understand and agree that the services provided by this application may include advertisements, and agree to display advertisements provided by FIBREVIEW in the process of using the application services, and agree that FIBREVIEW will send promotional information to the user's registered contact information by email or other means or other relevant business information.
3.6 You shall use the licensed software in a normal manner. And Users must abide by the following items:
1)Do not use this application for any illegal purpose.
2)Do not collect information or data of other users without authorization, for example, email address and etc.
3)Do not issue or share computer virus, worms, malicious codes, or software that deliberately damages or changes computer system or data.
4)Do not maliciously use the product in an automatic way, causing over load to the server, or interfere with or damage web server and network links in other forms.
5)Do not attempt to visit and visit server data or communication data of the product without authorization.
6)Do not Interfere with or damage the production application by other users.
7)Comply with all network protocols, regulations and procedures related to this application.
8)Do not use this application for any behavior that may adversely affect the normal operation of the Internet.
9)Do not use this application to publish any harassing, slanderous, abusive, threatening, vulgar obscene or any other illegal information.
10)Do not use this application for any behavior that is unfavorable to FIBREVIEW and any other third party.
11)Do not infringe the patent rights, copyrights, trademark rights, reputation rights or any other legitimate rights and interests of FIBREVIEW and any other third party,
12)Regarding the services, products, and business consultation of FIBREVIEW and its business partners, the communication channels provided by the corresponding institutions shall be adopted, and negative publicity about FIBREVIEW and related application services shall not be published in public.
13)If you find any illegal use of the user account or any security loopholes in the account, you should immediately notify the FIBREVIEW.
14)Users are not allowed to use any means or methods to attempt to attack the servers and other facilities of the FIBREVIEW, illegally obtain or modify unauthorized data, affect normal application services, and any other harmful purposes.
15)You promise that all images, videos, or any other form of content uploaded within this app are original to you, or you have obtained all necessary copyrights and licenses to publish these contents on this app. For the content you upload to this app, you guarantee that it will not infringe any third-party intellectual property rights, including but not limited to copyright, trademark rights, portrait rights, or privacy rights.
16)If the content you upload involves infringing on the copyright of others, you will bear all legal responsibilities, including but not limited to compensating for the losses caused to the APP platform and other related parties due to the infringement behavior. This app has the right to delete suspected infringing content without notice based on actual circumstances, and reserves the right to pursue legal responsibility.
3.7 If the user violates any of the above items when using this application, FIBREVIEW has the right to require the user to correct or directly take all necessary measures (including but not limited to suspending or terminating the user's right to use the application) to relieve the effects which made by user.
IV.A Third Party
4.1 You acknowledge that certain service of FIBREVIEW is based on software or services provided by a third party. Such service is set to facilitate your application and necessary legal authorization is obtained from the third party.
4.2 The product includes certain information and services of the third party. FIBREVIEW neither controls nor bears responsibility for information and services of the third party.
4.3 You acknowledge that FIBREVIEW cannot guarantee that the licensed software always uses or contains such services, or that other software provided by the same third party will be used in future. Likewise, it may use similar services supplied by another third party. Upon application, the aforesaid corresponding software or services are subject to this Agreement.
V.Private Policy and Data
5.1 It is crucial for FIBREVIEW to protect your personal information. FIBREVIEW also provides Privacy Policy of FIBREVIEW Platform, in which contents related to ownership and protection of intellectual property, collection, use, share, storage and protection, etc. of your information are disclosed. You are suggested to thoroughly read Privacy Policy of FIBREVIEW Platform.
5.2 FIBREVIEW may cooperate with a third party to provide users with relevant application services. In this case, if the third party agrees to undertake the same responsibility as FIBREVIEW for protecting user privacy, FIBREVIEW has the right to use the user's Records, etc. are provided to this third party.
5.3 Without the user's permission, FIBREVIEW shall not disclose or share the user data, device information and usage records in the user account to any third party, except in the following cases:
1)With prior explicit authorization from the user or the user's guardian.
2)Required by relevant laws and regulations.
3)Provided in accordance with the requirements of relevant government authorities based on legal procedures.
4)When FIBREVIEW files a lawsuit or arbitration against users in order to protect its legitimate rights and interests。
5)To safeguard the interests of the public.
VI.Agreement Termination and Breach of Agreement
6.1 You should understand, in view of the particularity of the application service, the user agrees that FIBREVIEW has the right to change, interrupt or terminate part or all of the application service at any time according to the business development situation without notifying the user, nor assuming any responsibility to any user or any third party.
6.2 You should understands that FIBREVIEW needs to update, repair or maintain the platform (such as Internet website, mobile network, etc.) or related equipment that provides this application on a regular or irregular basis, such as the interruption of application services within a reasonable time due to such circumstances, FIBREVIEW does not need to take any responsibility for this, but FIBREVIEW should notify in advance as much as possible.
6.3 The licensed software is downloaded from the downloading platform and you shall abide by stipulations of the download platform, system platform and terminal manufacture on application ways and restrictions of the licensed software. If the above mentioned third party confirms that you are in breach of the agreement and FIBREVIEW's treatment is required, FIBREVIEW may terminate your application license at the third party's request.
6.4 When the application license terminates, you shall stop using the licensed software and destroy all copies.
6.5 You must bear all compensation responsibilities if FIBREVIEW and other users suffer from losses caused by your breach of terms in the Agreement.
6.6 If the user violates the rules of use stipulated in this agreement, FIBREVIEW has the right to interrupt or terminate the service provided by this application to the user at any time without taking any responsibility for the user or any third party.
VII.Intellectual Property
7.1 The intellectual property rights of this application and all its contents such as software, text, sound, pictures, graphics, charts, audio and video are owned by FIBREVIEW and are protected by patent law, copyright law, trademark law and other laws and regulations; With the written authorization of FIBREVIEW or other relevant rights holders, no one may use, copy, modify, change, disseminate, publicly issue or publish the program or content related to this application without authorization.
7.2 All rights to any third-party software (including but not limited to any images, photos, animations, videos, audio recordings, music, text and additional programs, accompanying help materials contained in the software) used by this application to provide services are reserved It belongs to the copyright owner of the software. Without the permission of the copyright owner of the software, the user shall not reverse engineer, decompile or disassemble the software.
VIII.Exception Clauses
8.1 Unless otherwise specified in laws and regulations, FIBREVIEW will do its best to ensure the security, validity, accuracy and reliability of the licensed software and technologies and information involved, but FIBREVIEW is unable to guarantee the same due to restriction by available technologies nowadays.
8.2 You understand that FIBREVIEW will not assume responsibility for direct or indirect losses caused by force majeure and default of a third party
8.3 FIBREVIEW does not guarantee the accuracy and completeness of the external links set up for the convenience of users. At the same time, FIBREVIEW does not guarantee the content of any webpages pointed to by such external links that are not actually controlled by FIBREVIEW, and FIBREVIEW shall be free from legal responsibilities.
8.4 You have been informed of that the usage of FIBREVIEW Platform involves in Internet service, which may be affected by unstable factors in all links. Although FIBREVIEW has taken safeguard measures, the service may be suspended, terminated, delayed, suffered from application restriction or application failure due to inherent defects of Internet and e-communication as well as factors beyond reasonable control of any party to the Agreement (including but not limited to fire, flood, terrorist attack, pestilence, natural disasters, riot, terminal virus, hacker attack, network fault and terminal fault). You hereby agree to bear foregoing risks and agree that FIBREVIEW is free from any responsibility when normal running of services are influenced by the occurrence of foregoing risks.
8.5 Although this app will make every effort to review the content uploaded by users, we cannot guarantee that all content is free of copyright disputes. Therefore, this APP assumes no direct or indirect responsibility for the legality, accuracy, or completeness of the content uploaded by users.
8.6 This APP shall not be liable for any copyright disputes arising from the user's use of this APP, unless such disputes are directly caused by the actions of this APP.
IX.Governing Laws and Severability
9.1 Effectiveness, explanation, change, execution and dispute settlement of the Agreement are subject to laws of the People's Republic of China. If no relevant laws and regulations are available, reference to general international business practices and (or) industrial practices shall be made.
9.2 When any term of the Agreement is judged to be invalid by the People's Court, it will not influence the effectiveness of other terms or any part thereof, and you and FIBREVIEW shall perform the valid terms in good faith.
9.3 The Agreement is signed in HaiDian District, Beijing City.
9.4 FIBREVIEW has the right to interpret and modify this agreement to the maximum extent permitted by law.
